LEGAL NOTICE

This Legal Notice governs access to and use of the portal accessible through the domain name: https://join-the-group.com/ (hereinafter, the "Portal").  

Access to the Portal grants the status of Portal user (hereinafter, the "User") and implies acceptance of all the terms included in this Legal Notice. If the User does not agree with this Legal Notice, the User must immediately leave the Portal without using it.  

The User must read this Legal Notice carefully each time any access to the Portal is made, as the Portal and this Legal Notice may undergo modifications.

The owner of the Portal reserves the right to make, at any time and without prior notice, any modification or update of its contents and services, of this Legal Notice and, in general, of any elements that compose the design and configuration of the Portal.

2. TERMS OF USE

i. Rules for using the Portal

The User undertakes to use the Portal and all its content and services in accordance with the law, morality, public order and this Legal Notice. Likewise, the User undertakes to make appropriate use of the services and/or contents of the Portal and not to use them for illicit or criminal activities that may infringe the rights of third parties and/or the regulations on intellectual and industrial property, or any other applicable legal regulations.

The User undertakes not to transmit, introduce, circulate or make available to third parties any type of material and information (data, content, messages, drawings, sound and image files, photographs, software, etc.) that are contrary to the law, morality, public order and this Legal Notice. By way of example, but not limited to, the User undertakes to:

• Not to introduce or circulate content or propaganda of a racist or xenophobic nature or that in any other way infringes the rights of third parties.
• Not to introduce or circulate on the network data programmes (viruses and harmful software) likely to cause damage to the computer systems of the access provider, its suppliers or third party users of the Internet network.
• Not to introduce or circulate any false, ambiguous or inaccurate information and content in such a way as to mislead the recipients of the information.
• Not to spread, transmit or make available to third parties any type of information, element or content that violates the intellectual and industrial property rights, patents, trademarks that correspond to the owners of the Portal or third parties.
• Not to spread, transmit or make available to third parties any type of information, element or content that violates the secrecy of communications and personal data legislation.

The User undertakes to hold the Responsible Party harmless against any possible claim, fine, penalty or sanction that it may be obliged to bear as a consequence of the User's non-compliance with any of the rules of use indicated above, and the Responsible Party also reserves the right to request the corresponding compensation for damages.

ii. Operation of the Portal 

The Portal has been designed so that the User can join the AUDAX Group's talent network, find out about vacancies and submit their application. To do this, the Portal requires the registration of the User by providing their full name, as well as their email address, and is free to use.  

In the event that you join the AUDAX Group talent network and/or apply for any of our vacancies, the data you have provided will be stored in a database of candidates to which the different entities of the AUDAX Group will have access. These entities may contact you by e-mail to inform you about vacancies that may be of interest to you and the status of your application.

In the event of being selected to take part in any selection process, your application will be managed solely by the AUDAX Group entity responsible for the process, which will contact the User to begin the interview process.

Use of the Portal implies acceptance of this Legal Notice and all applicable legal texts.

iii. Exclusion of Liability

The Owner shall not be liable for any damage caused to the software and computer equipment of Users or third parties during the use of the services offered on the Portal.  

The Owner shall not be liable for damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the Portal's service during or prior to the provision of the same.

The User assumes that, in the event of making decisions based on the information provided on the Portal, the responsibility shall be exclusively theirs, and they will not be able to make any claim against the Owner for the consequences of the decisions taken.

iv. Intellectual property

All the contents of the Portal, including but not limited to texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source codes, are the intellectual property of the Owner or of third parties, and none of the exploitation rights recognised by current legislation on intellectual property on the same may be understood to have been transferred to the User.

The trademarks, trade names or distinctive signs are owned by the Owner or third parties, without it being understood that access to the Portal attributes any right over them.

3. SEVERABILITY

If any clause included in this Legal Notice is declared totally or partially void or ineffective, such nullity or ineffectiveness will only affect that provision or that part of it that is void or ineffective, and this Legal Notice will remain in force in all other respects, and such provision will be considered totally or partially as not included.

4. APPLICABLE LAW AND JURISDICTION

This Legal Notice shall be governed by and construed in accordance with the laws of Spain.

The Owner and the User agree to submit any dispute that may arise between the Parties to the Courts and Tribunals of the city of Badalona, unless any law, and in particular the law applicable to consumers, establishes a different jurisdiction.
