What personal data will be processed?

The personal information processed by the Data Controllers will be that which you provide us with through the different data collection forms provided on the Portal. The main categories of personal data processed will be the following: identification and contact data, personal characteristics data, academic data, professional and employment data, as well as any other data contained in the documentation provided by you to submit your application.

For what purpose will we process your personal data and what is the legal basis?

The Data Controllers will process your personal data for the following purposes and legal bases:

  • Manage your registration, which will entail the creation of an account as a user of the Audax Group external employment portal. This account allows you to centralise any question related to your user status, as well as giving you access to certain functionalities available and reserved to those with this status. For example, you can create a profile and apply for certain job offers.
    • The legal basis that legitimizes the processing of your personal data for this purpose is the performance of a contract, understood as such the terms and conditions of use of the Portal at the time of the creation of the account. The processing of your personal data is necessary to ensure compliance with the obligations and rights provided for in the terms and conditions of use of the Portal.
  • Management of possible candidacies to which the candidate applies. Manage their participation in the selection processes promoted by the Data Controllers, in the phase of reception, evaluation and monitoring of their applications.
    • The legal basis that legitimates the processing of your personal data for this purpose is the performance of pre-contractual measures adopted at the request of the data subject, understood as the employment contract. The processing of your personal data is necessary for the implementation of pre-contractual measures with the intention of concluding a contract.
  • Get notifications about new job opportunities and job vacancies.
    • The legal basis that legitimizes the processing of your data for this purpose is the express consent given by you, which may be withdrawn at any time without the withdrawal affecting the lawfulness of the processing based on the consent prior to its withdrawal.
  • The performance of internal studies for statistical purposes.
    • The processing of your data for this purpose is legitimised by the legitimate interest of the Data Controllers in analysing and improving our selection processes, evaluating trends in the recruitment of talent and optimising our recruitment strategies. Under no circumstances will the results of these analyses allow the individual identification of the candidate.

  • The management of your data protection rights and response to any complaints you may make to the Data Controllers.
    • The legal basis that legitimises the processing of your personal data is the compliance of a legal obligation with regard to the management of the exercise of rights in accordance with the obligation provided for in the GDPR.
    • In the event that your data are processed in order to deal with a complaint or claim, your data will be processed in order to comply with a legal obligation under consumer and user law.

How long do we keep your personal data?

Your personal data will be kept only for the time necessary to fulfil the purposes described in this Privacy Policy, ensuring that its processing is adequate, relevant and limited to what is strictly necessary to fulfil the purposes for which the processing is intended.

Once the personal information collected ceases to be useful and necessary for the specific purpose described in the previous sections, the Data Controllers, in accordance with the provisions of article 32 of Organic Law 3/2018, on data protection and guarantee of digital rights and article 17. 3 of the General Data Protection Regulation 2016/679 (hereinafter, the ‘GDPR’), shall proceed to block your personal data from all systems, and shall be kept only to make them available to the competent authorities to meet possible administrative or judicial liabilities and for the exercise or defence of claims during the period of limitation of any actions that may arise.

Once the blocking period has elapsed, your personal information will be definitively deleted.

To whom will your personal data be communicated?

Your personal data may be processed by third parties, expressly designated as data processors, who carry out the management of selection processes, specifically in the phase of receiving applications, as well as other companies that provide technological and/or computer services or the preparation of statistical studies, where appropriate.

We take this opportunity to inform you that in compliance with the provisions of article 28.3 of the GDPR, the relationship with the different data processors is duly regularised through the signing of the corresponding data processor contract. These third parties will process your personal data following the instructions of the Data Controllers and never for their own purposes.

Likewise, when required by law, your data may be communicated to public administrations, as well as other authorities and public bodies as appropriate.

International transfers are not foreseen, however, in the event that it is finally necessary to transfer your personal data outside the European Economic Area, they will be lawful, as the Data Controllers will carry them out by establishing the appropriate guarantees to protect your personal data, using any of the mechanisms foreseen in Chapter V of the GDPR.

We inform you that the Data Controllers have implemented the necessary technical and organizational measures to ensure the security of your personal information and prevent its alteration, destruction, loss or unauthorized processing.

When determining these measures, criteria such as the state of the art, the existing risks, as well as the nature, scope, context and purposes of the processing have been taken into account.

What are your privacy rights?

You may exercise your rights of access, rectification, erasure, opposition, limitation of processing and data portability in the cases and with the scope established by the applicable regulations at any given time. In your case, you will have the right to withdraw your consent at any time without the withdrawal affecting the lawfulness of the processing based on the consent prior to its withdrawal.

Likewise, we inform you that your personal data will not be subject to automated individual decisions.

Can the Privacy Policy be modified?

The Data Controllers reserve the right to modify this Privacy Policy in order to adapt it to new legislation, case law, industry practice or the interests of the Data Controllers. Any modification will be published on the external job portal for consultation.

In the event that we proceed to substantially and relevantly modify the content of the same, we will notify you through our platforms or to your email address, thus complying with the duty of information provided for in the GDPR. So that, if you consider it appropriate, you can exercise your rights as a data subject.
